1.1 About Us

These Terms and Conditions (“Terms”) govern your access to and use of the Wakatipu High School Alumni website (“Website”) hosted on the ToucanTech platform and operated on behalf of Wakatipu High School (“we,” “us,” or “our”). Contact: alumni@wakatipu.school.nz.

By accessing or using this Website you agree to be bound by these Terms. If you do not agree, please stop using the Website immediately.

1.2 Compliance with New Zealand Law

These Terms are governed by New Zealand law. Nothing in these Terms excludes, restricts, or modifies any rights you may have under:

• Consumer Guarantees Act 1993 (CGA)
• Fair Trading Act 1986 (FTA)
• Privacy Act 2020
• Privacy Amendment Act 2025 (IPP3A)
• Harmful Digital Communications Act 2015 (HDCA)
• Unsolicited Electronic Messages Act 2007 (UEMA)

Where you are a consumer within the meaning of the CGA, your statutory rights cannot be excluded. If you are acquiring services for business purposes, the CGA may be contracted out of to the extent permitted by section 43 of that Act.

1.3 Eligibility

You must be at least 18 years of age to use this Website independently. Users under 18 may participate only with the consent of a parent or legal guardian. We do not knowingly collect personal information from children in breach of the Privacy Act 2020.

1.4 Alumni Membership

The Website is intended for current and former students, staff, and supporters of Wakatipu High School. Membership is subject to verification. We reserve the right to refuse or revoke access at our discretion.

1.5 Acceptable Use

You agree not to:

• Use the Website in breach of any New Zealand law or regulation.
• Engage in misleading or deceptive conduct contrary to the Fair Trading Act 1986.
• Post content that is harmful, abusive, defamatory, or discriminatory, or that constitutes a harmful digital communication under the Harmful Digital Communications Act 2015.
• Upload malicious software or attempt unauthorised access to systems.
• Impersonate any person or entity, or misrepresent your affiliation with Wakatipu High School.

We may remove content or restrict access without notice where these Terms are breached.

1.6 User-Generated Content

By submitting content (including photos, posts, or comments) to the Website, you:

• Grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content for the purpose of operating the Website.
• Warrant that you hold the rights to submit that content and that it does not breach any law or third-party rights.

We reserve the right to remove any content at our discretion.

1.7 Intellectual Property

All intellectual property on the Website — including text, graphics, logos, and design — is owned by or licensed to Wakatipu High School. You may view and download content for personal, non-commercial purposes only. Reproduction, distribution, or modification of content for commercial purposes requires prior written permission.

1.8 Third-Party Platform (ToucanTech)

This Website is hosted on the ToucanTech platform. ToucanTech's own terms of service and data processing agreements apply alongside these Terms. Data is stored on AWS servers located in the Asia-Pacific region. We are satisfied these arrangements provide safeguards comparable to those required by the Privacy Act 2020.

1.9 Website Availability

The Website is provided on an “as available” basis. We do not guarantee uninterrupted access, error-free operation, or that content will be current at all times. We may suspend or modify the Website without notice.

1.10 Disclaimer

To the extent permitted by law, the Website and its content are provided without warranties of any kind, whether express or implied. Nothing in these Terms limits or excludes any guarantee that cannot be excluded under the Consumer Guarantees Act 1993.

1.11 Limitation of Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under New Zealand law. Subject to the above and to the extent permitted by law, we will not be liable for indirect or consequential loss, loss of data, loss of profits, or business interruption.

1.12 Electronic Communications

If you subscribe to our newsletters or other communications, we will comply with the Unsolicited Electronic Messages Act 2007. You may unsubscribe at any time via the unsubscribe link in any communication or by emailing alumni@wakatipu.school.nz.

1.13 Suspension and Termination

We may suspend or terminate your access if you breach these Terms, if required by law, or where necessary to protect the Website or its users. Termination does not affect any accrued rights or liabilities.

1.14 Changes to These Terms

We may update these Terms from time to time. Updated Terms will be effective from the date they are published on this Website. Continued use of the Website constitutes acceptance of the updated Terms.

1.15 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force and effect.

1.16 Governing Law and Jurisdiction

These Terms are governed by the laws of New Zealand. You submit to the exclusive jurisdiction of the courts of New Zealand. Nothing in these Terms affects your rights as a consumer to bring proceedings in the appropriate New Zealand court or tribunal.
